Human rights are those rights of a person that is very fundamental to his/her existence and cannot be taken from any individual by anyone. These rights are given to us humans regardless of our sex, nationality, race or any other factor. As humans, we are all the same and should all be treated with respect and dignity. Human rights are universal which mean they are applicable to all humans always under any circumstances. The main purpose of this essay is to discuss and understand if the right not to be tortured an inalienable human right which means that it is the right that should never be taken away from the possessor at any given time. The list of human right declares that “no one shall be subjected to torture or to cruel, inhumane or degrading treatment or punishment” (article 5, UDHR, 1948.). Therefore, it is very clear to state that no individual should be subjected to any sort of inhumane and cruel treatment because it is the right given to us. However, to further discuss the permissibility or impermissibility of torture at any circumstance we need to know what torture is. According to Torture Convection, torture is defined as any act by which the person possesses severe pain or suffering, it can be physical or mental and it does not need the victims on the edge of death.
